Article 1 (Scope of Application)
These Terms of Use (the “Terms”) set forth the conditions governing the use of the VR content service entitled “Happy Safety” (the “Service”), provided by Happy Quality Co., Ltd. (the “Company”).
By downloading, installing, or using the Service, the user (“User”) is deemed to have agreed to these Terms.
Article 2 (Supported Devices and Method of Provision)
- The Service is compatible only with Meta Quest 2 and later models. The Service does not operate on any other VR devices.
- The Service is provided exclusively through a dedicated page designated by the Company and is not distributed via general distribution platforms, including but not limited to Steam or Meta Store.
Article 3 (Service Description and License Grant)
- The Service provides VR-based training experiences designed for agricultural workers and general users, enabling them to learn about hazard simulation and emergency response in agricultural environments.
- Subject to the User’s compliance with these Terms, the Company hereby grants the User a non-exclusive, non-transferable, revocable license to use the Service solely for personal and non-commercial purposes.
- The Service shall be used at the User’s own risk, and the User shall be solely responsible for managing their usage environment, physical condition, and safety while using the Service.
Article 4 (Purchase, Orders, and Payment)
- Each content item within the Service is provided on a pay-per-purchase basis. Users must complete payment through Stripe, using the purchase button on the platform designated by the Company.
- Users shall provide accurate, complete, and current information at the time of purchase. The Company shall bear no liability for any issues arising from incorrect or outdated information.
- A legally binding contract shall be deemed concluded, and the license to use the applicable content shall be granted, upon successful completion of payment processing.
- Due to the nature of digital content, purchases are non-refundable in principle. However, refunds may be issued solely at the Company’s discretion through its prescribed procedures in the following cases:
- Where the Service could not be properly downloaded or launched due to technical defects attributable to the Company;
- Where duplicate charges occurred for the same content.
- Erroneous purchases, as well as issues arising from the User’s device environment, communication conditions, or personal circumstances, shall not be eligible for refunds.
Article 5 (Health and Safety Precautions)
Users acknowledge and agree that use of the Service involves certain health and safety risks, and shall carefully observe the following precautions:
1.Seizures and Loss of Consciousness
Flashing lights or certain visual effects may induce epileptic seizures or loss of consciousness.
If the User or any family member has a history of such conditions, the User is strongly advised to consult a physician prior to using the Service.
2. Motion Sickness and Physical Discomfort
Users should refrain from using the Service when experiencing fatigue, sleep deprivation, alcohol consumption, stress, anxiety, colds, or other physical discomfort.
If symptoms such as dizziness, nausea, or discomfort occur during use, the User shall immediately discontinue use.
3. Injury, Eye Strain, and Physical Fatigue
Users should avoid prolonged continuous use and are advised to take a break of 10 to 15 minutes every 30 minutes.
If pain or fatigue occurs in the arms, wrists, eyes, or other body parts, the User shall immediately rest and, if necessary, seek medical attention.
4. Securing a Safe Play Area
Users shall ensure a clear play area with a radius of at least one (1) meter, free of obstacles, and shall avoid contact with other persons, furniture, or surrounding objects.
The use of the Service at a volume level that allows awareness of surrounding sounds is recommended.
Article 6 (Prohibited Conduct)
Users shall not engage in any of the following acts:
- Commercial use, modification, reproduction, redistribution, or reverse engineering of the Service
- Acts that impose an excessive load on the Company’s network or systems
- Unauthorized access to the Company’s network, servers, or software
- Providing false information or impersonating a third party
- Acts that interfere with or disrupt the operation of the Service
- Providing benefits to antisocial forces or equivalent organizations
- Any other conduct deemed inappropriate or improper by the Company
Article 7 (Intellectual Property Rights)
All copyrights, trademarks, and all other intellectual property rights contained in the Service shall belong to the Company or its respective licensors.
Users may use the Service solely within the scope of personal, non-commercial use, and no rights other than those expressly granted under these Terms are transferred to the User.
Article 8 (Disclaimer and Limitation of Liability)
- The Company shall not be liable for any accidents, injuries, or damages arising out of or in connection with the User’s device environment, physical condition, network conditions, or communication environment.
- The Company makes no representations or warranties of any kind, whether express or implied, regarding the accuracy, usefulness, reliability, completeness, or non-infringement of intellectual property rights of any information or data provided through the Service.
- The Company shall not be liable for any damages whatsoever arising out of or in connection with the interruption, suspension, termination, modification, or discontinuation of the Service.
Article 9 (Handling of Personal Information)
The Company shall handle the User’s personal information appropriately and in accordance with its Privacy Policy(URL to be inserted).
Article 10 (Amendments to the Terms)
- The Company may revise these Terms from time to time as necessary.
- Any revised Terms shall become effective upon being posted within the Service.
- If the User continues to use the Service after such revisions take effect, the User shall be deemed to have agreed to the revised Terms.
Article 11 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any and all disputes arising out of or in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the Hamamatsu Branch of the Shizuoka District Court, as the court of first instance.
Supplementary Provision
These Terms shall become effective as of August 26, 2025.
